Phase I Environmental Site Assessment

A Phase I Environmental Site Assessment (ESA) is one of the steps in completing All Appropriate Inquiries (AAI) to satisfy the CERCLA Innocent Landowners Defense. This stage of assessment includes a visual and observational inspection of the grounds and structures on a property. We believe that appropriate inquiry in a Phase I ESA should be thorough and useful, but does not necessarily mean conducting an exhaustive assessment of a clean property. A Phase I ESA should be completed while recognizing that there is a point at which the cost of information, or the time required to gather it, outweighs its usefulness and may in fact become a detriment to the orderly completion of the project it is intended to support. Because of this fact, we strive to balance the competing goals of limiting costs and time demands in performing the Phase I ESA, and the reduction of uncertainty about potential environmental risks.
